Sometimes, it’s possible to resolve matters through discussion and come to an agreement. This might include setting up child support payments, revising an existing support agreement or establishing a plan for sharing special expenses, among other arrangements.

When an agreement is reached by all parties, we prepare the necessary legal documents, including the agreement, and submit them to the Court for homologation. Once homologated, the agreement acquires the same legal value as a court judgment and must be respected by both parties.

If your case has gone to court, a judgment will be issued. This judgment determines the amount of support, the frequency of payments, and other relevant terms.

Once rendered, the judgment is transmitted to Revenu Québec, the authority responsible for managing support payments in the province. Revenu Québec ensures that the terms of the judgment are enforced and that payments are made correctly.

If your situation changes significantly, you can request a review of the judgment. This can include changes such as substantial variations in your income, the end of the child’s financial dependence (after completing studies, for example), or any other change affecting custody arrangements.

Because child support is considered an urgent matter, it is always possible to go to court on an emergency basis (by way of a safeguard order) while awaiting trial. This allows for temporary support measures to be put in place or revised quickly, to ensure immediate financial support for the child on an interim basis.
